Halle Berry claimed that her ex-husband Olivier Martinez is trying to “delay” completing their agreed-upon therapy sessions as part of their co-parenting agreement by taking “the summer off” to travel.

Berry, 57, has asked the court to intervene so that the exes can get their co-parenting agreement for their 10-year-old son Maceo back on track, according to legal documents obtained by The Post.

The actress claimed Martinez, 58, “unilaterally decided to defer co-parenting therapy altogether until September because he was traveling to France in the month of July and because his brother will be visiting him in the month of August in Los Angeles.

The exes, who were married from 2013 to 2016, have been locked in a nasty divorce battle until 2023.

In May, the “X-Men” actress and Martinez reached a new co-parenting agreement.

As part of the agreement, the pair agreed to see a co-parenting coach for two individual sessions and at least six joint co-parenting sessions.

Berry’s current partner, Van Hunt, will also be allowed to attend the joint meetings.

Once the pair — who will split the cost of the sessions — reach their sixth session, the coach will decide if they need more sessions or if their work together is complete.

However, the pair haven’t made it that far and Berry claims that her ex has decided to galavant in Europe instead of attending the sessions.

According to the docs filed in Los Angeles last week, their “coparenting therapy was supposed to commence forthwith and the agreed-upon six conjoint sessions were to be completed by June 14, 2024. It is now July 26, 2024, and they have not even started.”

Berry alleged that “Olivier has effectively unilaterally decided to take ‘the summer off,’” noting that all co-parenting sessions take place on Zoom.

Berry claimed she’s “tried everything to foster a better coparenting relationship with Olivier” but “rather than support, she is met with resistance and conflict.”

She alleged that Martinez “has chosen to repeatedly violate agreements and court orders with careless disregard.”

Berry claims that her ex has decided to galavant in Europe instead of attending the agreed-upon sessions.

“To him, the terms of the parties’ stipulated court orders are simply suggestions to follow when it benefits him and which he ignores when it does not fit his alienation agenda,” the documents read.

Berry noted that “none of this is good for the parties, and it is certainly not good for Maceo.”

“Olivier’s conduct harms the parties’ son,” she claimed in the filing, adding it also “causes further damage to the parties’ already strained relationship.”

“If Olivier gets his way, nothing will begin until at least September because he unilaterally decided to take “the summer off,” she said in the docs.

She wants a judge to force Martinez to stick to their schedule.

However, Martinez has since hit back at Berry’s allegations, saying she filed her request when she “knew” he’d be traveling.

He claimed that the Emmy winner “is constantly attempting to harass and strong-arm Respondent [Martinez] by forcing him into ‘submission’ using her wealth, and the legal professionals at her disposal,” according to InTouch.

However, Martinez has since hit back at Berry’s allegations, saying she filed her request when she “knew” he’d be traveling. GC Images

He is demanding the judge deny his ex’s request.

Page Six has reached out to Berry and Martinez’s reps for comment.

Berry and the French actor separated in October 2015 after just two years of marriage. It wasn’t until nearly eight years later, in August 2023, that they finalized their divorce and custody agreement.

They were granted joint legal custody of their son and Berry agreed to pay Martinez $8,000 in monthly child support.

The “Catwoman” star is also required to pay Martinez “4.3% of any income she receives above $2,000,000” in additional support.

Additionally, the actress agreed to pay Maceo’s “private school tuition, school uniforms, and school supplies,” but the payments will go directly to the school and not her ex.

Berry also shares a 16-year-old daughter Nahla with ex-boyfriend Gabriel Aubry, whom she dated from 2005 to 2010.
