Halle Berry’s request to force ex-husband Oliver Martinez to attend co-parenting therapy was denied amid allegations that his absence negatively affected their 10-year-old son, Maceo.

According to court documents obtained by Radar Online, a judge denied the “Catwoman” star’s bid, citing a “lack of exigent circumstance.”

While Berry and Martinez, who were married from 2013 to 2016, are required to attend therapy sessions as a part of their divorce agreement, the actress has alleged the French actor has failed to show up to their meetings “because he wants to have the summer off.”

Last week, Berry’s legal team argued that Martinez’s absence was “thwarting the entire therapeutic process” and hindering the “development and best interests” of their son.

Per the outlet, the “Monster’s Ball” star, 57, claimed Martinez, 58, continuously involves Maceo in their arguments, leading him to act out against her.

Martinez’s team responded to Berry’s request, arguing she is “constantly attempting to strong-arm [him] by forcing him into ‘submission’ using her wealth, and the legal professionals at her disposal.”

His lawyer furthered that Maceo faced no immediate harm and alleged the “X-Men” star decided to file the request when she “knew” Martinez would be traveling.

Up until 2023, the former couple were in the middle of divorce proceedings.

In May, they settled on a new co-parenting agreement, agreeing to two individual sessions of therapy and six joint sessions.

Per court documents obtained by the Post, their agreed sessions were supposed to be completed by June 14. However, they haven’t started yet as Martinez plans to travel throughout Europe until September.

Berry and Martinez split in 2015 after two years of marriage. While they were legally declared single in 2016, the exes didn’t finalize their divorce until last year.

The two received joint custody of their son with the “Gothika” star agreeing to pay Martinez $8,000 per month in child support, “4.3% of any income she receives above $2,000,000″ and for the funds to cover their son’s schooling.

Berry is also mom to daughter Nahla, 16, whom she shares with ex-boyfriend Gabriel Aubry.
