Sam Bankman-Fried requests to stay in Brooklyn jail to access appeal counsel

FTX’s former CEO Sam Bankman-Fried, recently sentenced to 25 years in prison, has lodged a formal request to be housed at the Metropolitan Detention Center in Brooklyn, New York, according to a filing submitted to the US District Court this week. The request is intended to give him reasonable access to his appellate counsel as he prepares for his anticipated appeal.

The request, citing Rule 38(b)(2) of the Federal Rules of Criminal Procedure, asks the court to recommend to the Bureau of Prisons that he remain in Brooklyn. The rule allows for a defendant, here Bankman-Fried, to be confined near the trial or appeal location to assist in preparing the appeal if they are not released pending the process.

“If the defendant is not released pending appeal, the court may recommend to the Attorney General that the defendant be confined near the place of the trial or appeal for a period reasonably necessary to permit the defendant to assist in preparing the appeal,” cited the request.

In August 2023, Bankman-Fried was transferred to Brooklyn jail to await his fraud trial scheduled for October. Reports emerged that he spent time in jail promoting Solana.

In November 2023, Bankman-Fried was convicted on all seven charges against him. He was sentenced to 25 years in prison on March 28. However, his defense attorney, Marc Mukasey, has vowed to appeal the conviction.

Bankman-Fried himself confirmed the appeal possibility to ABC News earlier this month. He claims trial testimony misrepresented events and that his defense was restricted from presenting crucial evidence.
