Donald Trump has asked the U.S. Supreme Court to stop his scheduled sentencing on Friday for his criminal conviction related to hush money payments made to former porn star Stormy Daniels.

Trump’s legal team also is asking the court to weigh in on whether presidential immunity applies to a president-elect. They also want to justices to determine whether some of the evidence presented at the hush money trial should have been barred from the case, arguing that they were official acts.

Last year, in another case brought by Trump, the Supreme Court ruled that presidents are immune from criminal prosecution for their official acts while in office.

“This Court should enter an immediate stay of further proceedings in the New York trial court to prevent grave injustice and harm to the institution of the Presidency and the operations of the federal government,” Trump’s legal team wrote.

Last week, New York Judge Juan Merchan scheduled Trump’s sentencing, rejecting his legal team’s arguments that he was immune from prosecution. Merchan indicated that Trump would not face incarceration and that Trump could appear at the sentencing hearing virtually.

On Tuesday, a New York appellate court also refused to stop the sentencing.

Trump is the first president to be criminally convicted of a felony.
